In the file BmEngine find the line AllowD3D11, change True to False, saved and everything is ready, TEXMOD works. To steam version a little differently: copy TEXMOD to the folder with chesnokom game, rename it BatmanAC and chesnik game BatmanACOld. Then change AllowD3D11. Everything works.
